Property Variance Request & Decision
A public hearing was held July 26th before the Bellingham
Hearing Examiner to gather information and make a decision regarding the
variance application for reduced setbacks on a small lot at the corner of 47th
and Consolidation.
The building footprint for a new house would have been very
small if setback rules from the Consolidation arterial right-of-way were
strictly applied. An additional problem was the fact that the pavement
for Consolidation Street is in the far southern side of the right-of-way right
next to the property line.
The findings and conclusions of the Hearing Examiner are summarized below:
1.
47th Street will be defined as the front
yard with a 55 foot set back from the center line and a 10 foot set back
from the rear property line.
2.
A 15 foot set back from Consolidation right-of-way line will
be given.
3.
An inside property line set back will be 5 feet.
4.
Access cannot come from Consolidation and must come from
47th at a point adhering to the vision clearance rules at the
corner and with Public Works Department approval
5.
All other rules of clearing the lot and building codes must be
followed
